Terms & Conditions
Last updated: April 2026
These Terms & Conditions ("Terms") govern your use of the SMOOU web application available at smoou.app (the "Service"), operated by Gianluca Suarato ("we", "us", "our"), residing in Italy. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of the Service
SMOOU is a free web application that allows users to create digital event invitations, share them via link, and manage RSVP responses. The Service is provided free of charge, with no premium tiers or in-app purchases.
2. Account Registration
To create invitations, you must sign in using Google OAuth or email/password. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to notify us promptly of any unauthorised use of your account.
3. Acceptable Use
You agree NOT to use the Service to:
• Create or share content that is illegal, defamatory, threatening, harassing, obscene, or otherwise objectionable.
• Impersonate any person or entity.
• Distribute spam, malware, or phishing links via invitation pages.
• Attempt to access other users' data or interfere with the Service's infrastructure.
• Use the Service for any commercial purpose without our prior written consent.
We reserve the right to suspend or terminate your account if you violate these Terms.
4. User-Generated Content
You retain ownership of all content you create on SMOOU (invitation titles, descriptions, notes, images). By using the Service, you grant us a limited, non-exclusive, royalty-free licence to host, display, and transmit your content solely for the purpose of operating the Service. We do not claim any intellectual property rights over your content. You are solely responsible for the content you publish.
5. Intellectual Property
The SMOOU name, logo, design, and source code are the property of Gianluca Suarato. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
6. Service Availability
The Service is provided on an "as is" and "as available" basis. We host on Vercel's free tier and use Turso's free database plan. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service at any time without prior notice.
7. Limitation of Liability
To the maximum extent permitted by applicable law (including Italian Civil Code Art. 1229), we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Given that the Service is provided entirely free of charge, our total aggregate liability for any claim shall not exceed €0. This limitation does not apply to damages caused by wilful misconduct (dolo) or gross negligence (colpa grave) as per mandatory Italian law.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
9. Termination
You may delete your account at any time from your profile page. We may terminate or suspend your access at any time for violation of these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
10. Governing Law & Jurisdiction
These Terms are governed by Italian law. If you are a consumer, this choice does not take away the protection of the mandatory rules of the country where you live, and you may bring proceedings before the courts of the place where you live or are domiciled, which are also the competent courts for any action against you. You can also contact us first at the address in these Terms to settle any dispute amicably.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
